These Terms and Conditions (“Terms”) govern your access to and use of the PureFantasy website and web application (the “Service”). The Service is provided by Grand Trade d.o.o. (“PureFantasy”, “we”, “us”, “our”).
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
0) Zero-Tolerance Safety Rules
It is strictly forbidden to create, upload, request, distribute, or otherwise use the Service for:
• Child sexual abuse material (CSAM) or any sexual content involving minors (including anything that appears to depict a minor), and
• Non-consensual intimate imagery and non-consensual deepfakes (including sexual content depicting a real person without their consent).
Violations will result in immediate account termination and may be reported to appropriate authorities.
1) Eligibility and Accounts
1.1 Age Requirement (18+ Only)
The Service is intended only for adults. You must be at least 18 years old to access or use the Service. If you are under 18, you may not use the Service for any reason.
1.2 Account Registration
You may need an account to use certain features. You agree to provide accurate information and to keep your account secure. You are responsible for all activity that occurs under your account.
1.3 Changes to the Service and Terms
We may update the Service and these Terms from time to time. Updated Terms are effective when posted. If changes materially affect your rights, we may also provide additional notice (for example, in-app or by email). Your continued use after changes means you accept the updated Terms.
2) The Service and AI Outputs
2.1 AI-Generated Content
The Service generates content using automated systems and may produce inaccurate, unexpected, or offensive results. You understand and accept that:
• Outputs may not be unique and similar outputs may be generated for other users.
• Outputs may contain errors or content you dislike.
• You use the Service and any outputs at your own risk.
2.2 Fictional Content; User-Provided Materials
Much of the content created through the Service may be AI-generated and fictional. However, if you upload or provide your own materials (including photos/videos) or prompts referencing real people, the resulting output may resemble real persons. You are solely responsible for ensuring you have all necessary rights and consents for any materials you provide and for your use of any outputs.
3) Acceptable Use
3.1 Your Commitments
You agree you will not use the Service to:
• Generate, upload, store, distribute, or request illegal content or content that violates any applicable law.
• Create or share CSAM, sexual content involving minors, or content that appears to depict minors.
• Create or share non-consensual intimate imagery, non-consensual deepfakes, harassment, or exploitation.
• Impersonate others, engage in fraud, or attempt to bypass safety systems.
• Upload content that infringes intellectual property, privacy, publicity rights, or other rights of any person.
• Reverse engineer, scrape, probe, or interfere with the Service or its security.
• Use the Service to create malware, phishing, or other harmful content.
• Use the Service in any way that could damage, disable, overburden, or impair the Service.
3.2 Adult Content
The Service may allow generation of consensual adult sexual content involving adults. That does not mean anything goes: content that is illegal, non-consensual, exploitative, or otherwise prohibited by these Terms is forbidden.
3.3 Enforcement
We may (but are not obligated to) monitor, remove, restrict, or block content or accounts, and we may suspend or terminate access at any time if we believe you violated these Terms, pose a risk, or for legal/compliance reasons.
4) Subscriptions, Billing, and Refunds
4.1 Plans and Pricing
We offer subscription plans and/or one-time purchases as described in the Service. Prices and features may change. If you are on a subscription, changes will apply at the next renewal unless stated otherwise.
4.2 Renewals and Cancellation
Subscriptions renew automatically unless canceled before the renewal date. You can cancel through your account settings or, if purchased through an app marketplace (e.g., Apple), through that marketplace’s subscription management.
Cancellation stops future renewals; it does not retroactively refund already-paid periods.
4.3 Refund Policy
All purchases are final and non-refundable except where required by law. If you believe you were charged incorrectly, contact us at hello@purefantasy.io.
4.4 EU/EEA/UK Consumer Notice (Digital Content/Services)
If you are a consumer in the EU/EEA/UK and you purchase digital content or digital services, you acknowledge that performance of the Service begins immediately upon purchase/activation. Where applicable under local law, you agree that you may lose any statutory right to withdraw once digital performance has begun.
Nothing in these Terms limits any mandatory consumer rights that cannot be waived under applicable law.
5) Your Content, Our License, and Ownership
5.1 Definitions
• “Inputs”: prompts, text, images, videos, or other materials you submit to the Service.
• “Outputs”: content generated by the Service in response to Inputs.
• “User Content”: Inputs and Outputs together.
5.2 Your Responsibilities for Inputs
You represent and warrant that:
• You have all rights, permissions, and consents needed to submit your Inputs and to allow us to process them to provide the Service.
• Your Inputs and your use of Outputs will not violate law or any third-party rights (including privacy, publicity, copyright, and trademark).
5.3 Ownership of Outputs
As between you and PureFantasy, and to the extent permitted by law:
• You own the Outputs you generate, and
• You retain any rights you have in your Inputs.
This ownership does not give you rights in PureFantasy’s underlying software, models, or Service.
5.4 License You Grant to Us (Required to Operate the Service)
You grant PureFantasy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and transmit your User Content only as necessary to:
• provide and operate the Service,
• maintain safety and security, prevent fraud and abuse,
• comply with legal obligations, and
• enforce these Terms.
5.5 Private Content and Training
We may process and store User Content to provide the Service and for security, fraud prevention, troubleshooting, compliance, and enforcement.
We do not use your private User Content to publicly market your content without your permission. If we ever want to feature specific user-generated outputs publicly (e.g., on a website gallery), we will request your consent first.
5.6 Removing Your Content
We may remove or restrict access to User Content at any time if we believe it violates these Terms, is illegal, is subject to a complaint, or presents risk.
6) Intellectual Property (Our IP)
The Service, including all software, features, design, branding, and underlying technology, is owned by PureFantasy and its licensors and is protected by intellectual property laws. Except as expressly stated, no rights are granted to you.
You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code or underlying components of the Service except where such restriction is prohibited by law.
7) Copyright and Rights Complaints (Takedown Process)
If you believe content on the Service infringes your copyright or other rights, email hello@purefantasy.io with:
• your name and contact information,
• identification of the content at issue (screenshots/links if possible),
• an explanation of your rights and why you believe they are infringed,
• a statement that the information is accurate and that you are the rights holder or authorized to act on their behalf.
We may remove content, restrict accounts, or take other actions as appropriate, including in cases of repeat offenders.
8) Termination
8.1 By You
You may stop using the Service at any time. If you have a subscription, you should cancel it to prevent renewal.
8.2 By Us
We may suspend or terminate your account or access immediately if:
• you violate these Terms,
• we suspect fraud, abuse, or security risk,
• we must comply with law or regulatory request,
• or continued operation is impractical or unsafe.
Termination may include loss of access to your account and content. We are not responsible for any resulting loss except as required by law.
9) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUREFANTASY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE, RELIABLE, OR MEET YOUR EXPECTATIONS.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
• PUREFANTASY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
• PUREFANTASY’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO PUREFANTASY FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including certain consumer protections).
11) Indemnification
You agree to defend, indemnify, and hold harmless PureFantasy, its affiliates, and their directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:
• your Inputs or Outputs,
• your use of the Service,
• your violation of these Terms,
• your violation of any law or third-party rights (including privacy/publicity/IP rights),
• or any allegation that your User Content caused harm or infringed someone’s rights.
12) Third-Party Services and Marketplaces (Including Apple)
If you download or access the Service through a third-party marketplace (such as Apple’s App Store), you acknowledge that:
• These Terms are between you and PureFantasy, not the marketplace provider.
• The marketplace provider has no obligation to provide support for the Service.
• Your use may also be subject to the marketplace’s terms and policies.
• To the extent required, the marketplace provider is a third-party beneficiary of these Terms and may enforce them.
13) Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you also agree to our Privacy Policy.
14) Governing Law and Disputes
14.1 Governing Law
These Terms are governed by the laws of Slovenia, without regard to conflict of law rules.
14.2 Jurisdiction
Except where mandatory consumer law provides otherwise, any dispute arising out of or relating to these Terms or the Service will be brought in the competent courts in Ljubljana, Slovenia, and you agree to that jurisdiction and venue.
15) Miscellaneous
• Severability: If any provision is found unenforceable, the rest remains in effect.
• No Waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign them as part of a business transfer.
• Entire Agreement: These Terms (and referenced policies) are the entire agreement between you and PureFantasy regarding the Service.
